ECJ: Legal videos can be integrated
Embedding videos raises legal issues. After all, by embedding a copyrighted YouTube video, it can spread almost indefinitely on the Internet - without the rights holder having any control over it. The lawyers have long been concerned with the question of the legal consequences of incorporation.
In 2014, the European Court of Justice (ECJ) finally created clarity (AZ: C-348/13). He decided: The mere integration of YouTube videos does not constitute a copyright infringement. "This only applies if you do not make a copy of the copyrighted work yourself or undertake other copyright-related acts of use," says lawyer Dr. Ansgar Koreng, who is a member of the German Lawyers' Association (DAV).
There are two main conditions:
No “new” viewers may be reached who would not have been able to see the video on YouTube anyway. For example, you cannot simply reset a video that has been set as “private” and make it accessible to all YouTube users.
No new technology may be used.
Both conditions are met when embedding a public YouTube video in the usual way.
The European judges clarified the question at the request of the German Federal Court of Justice (BGH). “It was a so-called preliminary ruling procedure. This means that the Federal Court of Justice put a legal question to the European Court of Justice, which was of decisive importance for the Federal Court of Justice ”, said lawyer Dr. Koreng.
